Terms and Conditions of Taste Gourmet Group (TGG) Membership Program

Taste Gourmet Group-TGG Membership Program is operated by Taste Gourmet Group Limited. TGG Card is issued by Taste Gourmet Group. The submission of an application for membership to Taste Gourmet Group is deemed to be an acceptance of these terms and conditions that are subject to amendments as shall be made by Taste Gourmet Group without notice from time to time.

Application & Membership

Application for membership shall be submitted through TGG Mobile APP with a valid email address and telephone number. Each valid telephone number and email address can register once only.
The applicant must be aged 13 or over.
Applicants must complete all mandatory fields in full and provide true and accurate information. Taste Gourmet Group will not process any incomplete or inaccurate application and reserves the right to decline any application at its sole discretion without giving any reason therefor.
Member can login to Account’s Area via TGG Mobile APP to check the expiry date of the membership.
Member has no right to participate in the constitution, operation or management of the Taste Gourmet Group Membership Program nor any right in or any claim to any assets of Taste Gourmet Group.

TGG Card

A virtual TGG Card will be issued to a member upon successful application.
Taste Gourmet Group Limited is not liable for any loss or damages suffered by member arising from the loss, theft or use of his/her TGG Card number or password whatsoever.
*Electronic payment/spending (dine-in, takeaway purchase and online takeaway ordering) at any of our restaurants in Hong Kong ONLY will be counted towards the cumulative spending amount, spending on third-party takeaway platforms will not be counted.
The cumulative spending amount is the actual amount settled by way of electronic payment, such amount shall include the 10% service charge and all other promotional offers and discounts where applicable.
The cumulative spending amount will be transferred into TGG Point as set out in the TGG Point section below. *Spending for banquet or events and deposit payment is not eligible for TGG Points accumulation.
TGG Card must be presented upon seated/payment to record the transaction, and the entire transaction can be recorded on one TGG account only.
Spending recorded in different TGG Cards cannot be combined.
Record of cumulative spending in a TGG Card will be updated next working day after the transaction. Members can check their cumulative spending record via TGG Mobile APP under ‘my account’. TGG record is final and conclusive.

TGG Card is not transferable or assignable and is for member’s personal use and benefit only. Verification of member’s identity may be required.

Personal information

Members shall keep their membership numbers and passwords strictly confidential and secure. Members are fully responsible for any use of their accounts by any other person (including any third parties, whether used with or without the member’s authorization).
All personal information collected under the TGG Membership Program shall be managed in accordance with the Personal Data (Privacy) Ordinance and the Privacy Policy Statement of Taste Gourmet Group.
Member is responsible for keeping Taste Gourmet Group updated on their correct mobile phone number and email address. Taste Gourmet Group is not responsible for any loss or damage as a result of member’s failure to notify Taste Gourmet Group of any change of mobile phone number and email address.
Any request to amend personal information can be made in writing to Taste Gourmet Group’s Data Privacy Officer through any one of the following methods:

Call us on (852) 3705 7586 (Office hours: Monday to Friday from 9:00am to 6:00pm, except public holidays).

Termination of Membership

Except otherwise expressly specified, TGG membership is valid for one year only from the day of successful registration or upgrading as the case may be.
A member may by sending a written request to Taste Gourmet Group to terminate his/her membership. Upon receipt of the said written request, the membership shall be terminated as soon as reasonably practicable and all unredeemed TGG Points shall be forfeited without further notice.
All relevant information (which may include personal data) will be retained for nine (9) months following the termination of membership.

Others

In the event of any breach of the Terms and Conditions of Taste Gourmet Group Membership Program, or the use of the TGG Card is unauthorized or arises from act of misconduct, fraudulent or otherwise unlawful, Taste Gourmet Group has the right to stop one’s participation in the Taste Gourmet Group Membership Program and/or immediately terminate one’s TGG membership or his/her application with or without notice. Taste Gourmet Group will not be liable for any loss or damage resulting therefrom and also has the right to take action for recovery of any loss suffered by Taste Gourmet Group as a result of the breach of the Terms and Conditions of Taste Gourmet Group Membership Program.
TGG will not bear any responsibility in any case of network problems, system malfunctioning, poor phone reception or blocking by third party applications that cause the delay, loss, mistake or corruption of an information transfer.
Taste Gourmet Group reserves the right to terminate TGG Membership Program and/or its operation at its sole discretion at any time with reasonable notice, where reasonably practicable, without giving any reason therefor. All rights and/or privileges of an applicant/member shall cease upon termination of the Program and Taste Gourmet Group will not be liable for any loss or damages resulting therefrom.
Not every member will be eligible to participate in all promotions and Taste Gourmet Group may from time to time impose other limitations on member’s participation in any promotion. Member taking part in any promotion shall be deemed to have agreed to be bound by the applicable terms and conditions which may be imposed by Taste Gourmet Group in relation to such promotion.
In the event of any dispute arising from TGG Point, TGG Card or TGG Membership Program, Taste Gourmet Group shall be the sole and final arbiter of such dispute and its decision shall be final and binding on an applicant and/or member.
Taste Gourmet Group reserves the right to amend the Terms and Conditions of TGG Membership Program or revoke any right and/ or privilege without prior notice. All changes or amendments are effective once announced on the Taste Gourmet Group website or TGG Mobile APP. Member’s continued use of TGG Card indicates the acceptance of any change to the Terms and Conditions of TGG Membership Program. In case of any dispute, decision of Taste Gourmet Group shall be final.
Taste Gourmet Group Mobile APP and virtual TGG Card are only applicable to designated mobile devices using iOS 13.0 or above and Android 6.0 or above (major models and brands).
If there is any inconsistency or conflict between the English version and Chinese version of the Terms and Conditions of TGG Membership Program, the English version shall prevail.

*Definitions:

Electronic payment/spending: Transactions that are processed electronically for example credit card (Visa, MasterCard, Amex), Unionpay, Alipay, WeChat Pay HK, etc.

Banquet/Events: For booking of 18 guests and above

TGG Membership Features (Tier and point)

1. TGG Silver-Tier Member

Applicant shall become a TGG Silver Member upon successful registration.
As a Silver Member every $20 HKD spend will be converted to 1 TGG Point.
A Silver Member with accumulated spending exceeds HK$8,000 during the validity of membership will be upgraded to TGG Gold Membership.
Spending on day of upgrading will be accumulated as Silver tier.

2. TGG Gold-Tier Member

As a Gold Member every $20 HKD spend will be converted to 2 TGG Points.
To maintain Gold Membership, the member is required to accumulate spending of no less than HK$8,000 during the validity of membership.
Spending on day of upgrading will be accumulated as Silver tier.
A Gold Member with accumulated spending exceeds HK$40,000 during the validity of membership will be upgraded to TGG Black Membership.
A Gold member will be re-designated as a Silver Member if the accumulated spending during the validity of Gold membership is less than HK$8,000.

3. TGG Black-Tier Member

As a Black member every $20 HKD spend will be converted to 3 TGG Points.
To maintain Black Membership, the member is required to accumulate spending of no less than HK$40,000 during the validity of membership.
Spending on day of upgrading will be accumulated as Gold tier.
A Black member will be re-designated as a Gold Member if the accumulated spending during the validity of Black membership is less than HK$40,000.

4. TGG Point(s)：

During the validity period of the TGG Membership (i.e. one year from the date of successful registration/upgrading), TGG Point will be credited for every $20 Hong Kong dollar spent (based on the total actual amount settled by way of electronic payment). Any amount below $20 Hong Kong dollar will not be credited as TGG Point. TGG Point conversion for different membership tiers as set out below. TGG Points can be used in the subsequent transaction at Hong Kong Taste Gourmet Group outlets. Point used will be deducted from the TGG Card account instantly at the transaction. Offer is valid for dine-in, takeaway and TGG App online takeaway purchase (not including third-party takeaway platform). Unused Point will be forfeited upon expiry of membership.

Upper limit for TGG Point registration and spending per member account per transaction day is HK$20,000 maximum. Only a maximum of 3 transactions can be registered/accumulated per member account per transaction day. This applies to promotional offers of all kinds, including but not limited to welcome offers, birthday offers, referral point rewards (if applicable), etc. Taste Gourmet Group shall have the right to cancel or deduct bonus points that are granted to any members by error without prior notice.

All reward TGG Points, cash vouchers, rewards, discount vouchers and promotional codes in TGG APP are governed by specific terms and conditions. They are neither refundable nor redeemable for cash. TGG Point cannot be sold, bought, transferred or moved to other accounts.

5. TGG Point to TGG Dollar

During the validity period of the TGG Membership (i.e. one year from the date of successful registration/upgrading), every 40 TGG Points can be redeemed as 20 TGG Dollars.

6. TGG Dollar

During the validity period of the TGG Membership (i.e. one year from the date of successful registration/upgrading), every 1 TGG Dollar is equivalent to $1 HKD and can be used in the subsequent transaction at Hong Kong Taste Gourmet Group outlets. TGG Dollar used will be deducted from the TGG Card account instantly at the transaction. TGG Dollar is only available for use for dine-in and takeaway excluding third party platforms. Unused TGG Dollar will be forfeited upon expiry of membership.

TGG Membership Privileges

1. Birthday Delights：

TGG members may enjoy a one-time special birthday surprises with at least a meal order at one of the Taste Gourmet Group outlets in Hong Kong during his/her birthday month (e.g. If the member's birthday is on 15 August, birthday month covers the period from 1-31 August.) by presenting his/her TGG Card and coupon QR code. Members will receive a push birthday delight coupon at ‘My coupon’ on the first day of their birthday month. Members can then select one of the delights offered at each participating TGG outlet.

Offer is valid upon availability and while stock last.

Please present valid TGG virtual membership card at the time of payment. This offer is only valid at Taste Gourmet Group outlets in Hong Kong. Only applicable for dine-in, or self pick-up takeaway order (not including third-party takeaway platform). Additional 10% service charge applies where applicable. Points can be used together with this birthday offer. This offer cannot be used in conjunction with other Taste Gourmet Group coupons, e-coupons, cash coupons, other promotional offers or discount. Birthday delight redemption must be with at least a meal order at one of the Taste Gourmet Group outlets in Hong Kong for dine-in or takeaway excluding orders from third party platforms.

We disclaim any warranty, obligation, risk or liability with regard to the gift items and/or dining vouchers and the use of the same, including without limitation warranty as to merchantability and fitness of any of the said items.

The above offers are subject to Terms and Conditions of TGG Membership Program. Taste Gourmet Group Limited reserves the right to amend the Terms and Conditions of TGG Membership Program without prior notice. In case of any disputes, the decision of Taste Gourmet Group Limited shall be final.

Terms and Conditions of Table Reservation for General Users (“Terms of Reservation”)

Set forth below are the Terms of Reservation governing any user’s use of the TGG APP online table reservation service with or without the use of any offer or discount provided by Restaurants (as defined below) which accept table reservation via TGG APP, including mobile webs and mobile applications and your utilization of the services available thereat (hereinafter referred to as “Reservation Service”). “You” and “Your” shall mean any user using the Reservation Service.

By using Reservation Service and/or the services thereat, whether as a registered member of the Channel (hereinafter referred to as “Member(s)”) or as non-registered user, you acknowledge and agree that the Terms and Conditions, this Terms of Reservation as well as the Privacy Policy are binding upon you. Access to and use of the contents of the Reservation Service provided on the Channels shall be subject to the Terms of Reservation and the Privacy Policy.

All references in the Terms of Reservation to “we”, “our” and “us” shall mean TGG and/or its restaurants(s) and/or affiliate(s).

1. TGG APP Online Table Reservation Service

1.1 Users of the Channel and Members are eligible to use the Reservation Service to make dining reservation (“Reservation”) across restaurants (“Restaurant(s)”) of Taste‧Gourmet Group Limited which accept online table booking.

1.2 Subject to the terms of this Terms of Reservation, you may make a Reservation by filling in the electronic reservation form (“Reservation Form”) available on the Channels online (herein TGG app or TGG website). You shall ensure the accuracy of all information provided in connection with your Reservation, including without limitation the intended dining date (“Dining Date”) and time, number of diners and your contact details.

1.3 Under no circumstances shall we entertain a Reservation request for a dining time which is less than the time as determined by our related Restaurants.

1.4 By making a Reservation through the our app or website, you acknowledge and agree that the information (including but not limited to your name, email address, telephone number and special request(s) (if any)) which you provide in your Reservation request and is necessary for the processing of your Reservation will be passed onto our relevant Restaurant.

1.5 You shall not submit multiple requests for a single table booking. In the event of such multiple requests being made, we may at our sole and absolute discretion (i) treat them as a single Reservation request or (ii) reject/cancel all such Reservation requests made by you without any compensation or recourse to you. In the event of any dispute, our determination shall be final and conclusive.

1.6 Numbers of Reservations which you can make during each period and for the same dining date respectively are determined by us. The aforesaid limits are subject to our adjustment from time to time without prior notice.

1.7 Pursuant to the terms of this Terms of Reservation, you may make a Reservation for a third party for non-commercial purpose only. For the avoidance of doubt, resale or attempted resale of Reservations is expressly prohibited. Where you provide us with information relating to any third party, you shall be responsible for obtaining such third party’s prior consent to the disclosure of the same to us, and you warrant that such third party has agreed to the collection and the use of the said information in accordance with the Terms of Reservation and the Privacy Policy.

1.8 Upon acceptance of your Reservation by our Restaurant, you will receive a confirmation email at your designated email account setting out the particulars of the Reservation (hereinafter referred to as “Reservation Confirmation”) and, if you are a Member, you can also view the Reservation Confirmation via your Reservation, ‘Record’. For the avoidance of doubt, the Reservation Confirmation will serve as the Restaurant’s acceptance of your booking of table but may not necessarily indicate its promise to satisfy your special request made under the Reservation, if any.

1.9 You may cancel your Reservation via in-app before the designated dining time as appearing in the Reservation Record. Reservation cannot be revised following confirmation. For changes on time/date/no. of guests/branch, please contact the relevant Restaurant directly and should the relevant Restaurant accept and make the requested changes, you will receive from us a revised Reservation confirmation (hereinafter referred to as “Revised Reservation Confirmation”) or confirmation of cancellation of Reservation (hereinafter referred to as “Cancellation Confirmation”) (as the case may be) in the form of email at your designated email account and, if you are a Member, you can view the aforesaid confirmations via your account inbox.

1.10 We make no guarantee that any of your requests in respect of a Reservation (including the special request made thereunder, if any) or variation or cancellation thereof made in accordance herewith will be timely processed or accepted by the relevant Restaurant.

1.11 We reserve the right to cancel any Reservation made by you, in which event, we shall notify you of it by email. We shall not be liable for any consequences of such cancellation howsoever arisen.

1.12 You shall honour the Reservation by patronizing the Restaurant on the Dining Date at the time specified in the Reservation Confirmation or Revised Reservation Confirmation (as the case may be), unless you have cancelled your Reservation in accordance with Clause 1.9. Where possible, Restaurant will call one day or on day of your designated dining date. We may also send you an email reminder 2-hour prior to your designated dining date and, if you are a Member, you may also receive the said reminder via your account inbox.

2. TGG Points Reward Scheme for Reservation (Applicable to Members only)

By participating in the TGG Points Reward Scheme, Members understand and agree that the following terms and conditions regarding TGG Points Reward Scheme are binding upon them:

2.1 Only Members can earn 2 TGG points per attendee for each booking made (calculated according to the scale as we may adopt and revise from time to time)

2.2 TGG points will be credited to the Member’s account next day after the Member has ‘Check-in’ Reservation in Restaurant. Member making the reservation is require showing their membership QR code during check-in. Only numbers of attendees check-in on Restaurant receipt will be credited TGG points.

2.3 If there is any dispute on the check-in attendance, you must provide us with written evidence, such as copy of the receipt issued by the Restaurant, by sending in an email to: [email protected] to appeal within 48 hours.

2.4 TGG points in different accounts cannot be combined.

2.5 TGG points which are obtained by improper means (including without limitation breach of the Terms of Booking) shall be forfeited at our sole and absolute discretion without any compensation or recourse or notice to the Member.

2.6 All TGG points are neither transferrable nor exchangeable for cash. For avoidable of doubt, no TGG points will be awarded for cancelled Reservation or no-show.

2.7 All Members acknowledge that their entitlement to the TGG points is at our sole and absolute discretion. We reserve the right to terminate and/or suspend TGG Points Reward Scheme and/or change or revise any terms of TGG Points Reward Scheme, in whole or in part, at any time with or without notice at its sole and absolute discretion.

3. Your Rights and Obligations

The Reservation Service may be used by you only for lawful, bona fide and personal non-commercial purposes and in a lawful manner. You agree to comply with all applicable laws and regulations regarding the Reservation Service and the Terms of Reservation contained herein.

4. Disclaimer and Limitation of Liability

We give no warranty as to the accuracy of the information contained on or given in relation to the Reservation Service and accept no liability arising from any inaccuracy of such information. Any typographical error, clerical or other error or omission on the Channels or other relevant information or document provided by us, including without limitation the Reservation Confirmation, Revised Reservation Confirmation and Cancellation Confirmation, shall be subject to our correction at any time without any liability on our part and we are not obliged to give you any notice in relation thereto.

5. General Terms

5.1 We shall not in any way be regarded as your agent in rendering our services hereunder.

5.2 We reserve the right to modify, suspend or withdraw, temporarily or permanently, the Reservation Service (or any part thereof) with or without notice to you. In any event, we shall not be liable to you for any modification to or suspension or withdrawal of the Reservation Service. We may terminate and/or suspend your use of and access to the Reservation Service (or any part thereof) or any related service(s) at any time with immediate effect without any notice and in our sole and absolute discretion for any reason, including without limitation the following:-

a. If you are unable to verify or authenticate any information you previously provided to us;

b. If we believe that your action may give rise to liability of any nature; or

c. If we deem your action unsuitable or inappropriate.

5.3 In the event of any dispute with respect to the online table reservation service hereunder or the TGG Points Reward Scheme, our decision shall be final and conclusive.

6. Rights of Third Parties

Except as expressly set forth herein, no person other than the parties to these Terms of Reservation shall have any right to enforce any term hereof.

TGG eShop Terms of Service

These terms of service apply to access and use of the TGG eShop website (https://www.tastegourmet.co/zh_HK/eshop) (“TGG eShop”) on any digital media. TGG eShop is administered by Taste Gourmet Group Limited (“TGG”).

Please read the following Terms of Service carefully before using TGG eShop. The Terms of Service create a legally binding agreement between you (the “user” or “Customer”) and TGG and its affiliates (individually and collectively, "Taste Gourmet Group", "we", "us" or "our").

General

The "Services" we provide or make available include: (a) TGG eShop, (b) the services provided by Taste Gourmet Group, the Retailers and any designated service provider(s) made available through the TGG eShop, and (c) all information, data, text, images, photographs, linked pages, graphics, music, sounds, video (including live streams), messages, tags, content, programming, software, application services or other materials made available through TGG eShop or its related services ("Content").
The Services include an online platform service that provides a place and opportunity for the sale and purchase of goods and services (“Products”) between a supplier (“Retailer”) and you (the “Customer”). A Retailer may or may not be an affiliate of Taste Gourmet Group. The actual contract for sale is directly between you and the Retailer and Taste Gourmet Group is not a party to that or any other contract between Retailer and Buyer. Taste Gourmet Group accepts no obligations in connection with any such contract.
Before becoming a user of TGG eShop, you must also consent to the processing of your personal data as described in the Privacy Policy, which can be accessed here: https://www.pcpd.org.hk/tc_chi/data_privacy_law/ordinance_at_a_Glance/ordinance.html
You agree not to use TGG eShop for any purpose or in any matter that is unlawful or infringes third party intellectual property rights.
We only serve and deliver Products to consumers/end-users. Products sold on TGG eShop are not for re-sale purpose. If we have grounds to believe that you are not purchasing Products as an end-user, we reserve the right to decline or cancel your order.
We reserve the right to change, modify, suspend or discontinue all or any part of the TGG eShop or the Services at any time or upon notice as required by local laws. We may also impose limits on certain features or restrict your access to parts of, or the entire, TGG eShop or Services in our sole discretion and without notice or liability.
We reserve the right to refuse to provide you access to the TGG eShop or Services or to allow you to open an Account for any reason.

BY USING THE SERVICES OR OPENING AN ACCOUNT, YOU ACCEPT AND CONSENT TO THE TERMS OF SERVICE, INCLUDING THOSE ADDITIONAL TERMS AND CONDITIONS AND POLICIES REFERENCED HEREIN AND/OR LINKED HERETO.

Orders

We reserve the right to only accept orders from you if you are of legal age and capacity to use TGG eShop in accordance with these Terms of Service and to create binding legal obligations in relation to the access and use of TGG eShop and the Products or Services.
Orders placed online are processed daily from Monday to Sunday with an order confirmation sent within 1 working day.
You may not exchange or redeem your order for cash or any other products or services.
We cannot refund, amend, or replace your order once payment is confirmed.
The products sold through TGG eShop may be provided by various retailers/suppliers, including but not limited to member restaurants of Taste Gourmet Group Limited (“TGG Restaurant(s)”) each a “Retailer”. Any orders made through TGG eShop are made between the Customer and either one or more of the Retailers. The order is subject to the local terms and conditions as may be imposed by the Retailers (where applicable) from time to time.
Customer may pick-up the products directly from TGG Restaurant (s) as long as one of the items in the order is sold by any of the above mentioned Retailer. At this stage, it is not possible for us to deliver products to locations within and outside Hong Kong.
Any order for perishable items will be void and the payment will be forfeited if: the Customer fails to pick-up the perishable product on the designated pick-up date and time from the relevant Retailer.
TGG eShop reserves the right to cancel or modify orders in its sole discretion for any reason but Customer will be entitled to a full or partial refund of any payment made in the event of any such cancellation or modification.
If an order is placed on a weekend or national holiday, it will be processed the following Hong Kong business day.
Product images are for illustrative purposes only and may differ from the actual product. Colours of products may also appear different to those shown on the site.
Retailers who offer food and beverage on TGG eShop carry licences for such product offerings. For further information, you may contact us at the customer service contact number / email and we will put you in touch with the Retailer.
Save in exceptional circumstances, you may not return or obtain a refund for a Product upon confirmation of your order. Your statutory rights are not affected.

TGG Points Reward

If you have made payment for an order while signed in as a member (“Member”) of the TGG membership programme, you will be eligible to earn TGG Points (“Point”) on Qualifying Charges on TGG eShop. Points will be issued at the rate of one Point per $20 HKD for Silver tier member, two Points per $20 HKD for Gold tier member and three Points per $20 HKD for Black tier member of qualifying spending.
Cash vouchers or gift cards with monetary value are not eligible to earn Points (base or bonus Points inclusive) at the point of purchase on TGG eShop.
Promotions that offer bonus Points may be offered at certain times.
All Points (including Bonus Points) will be credited to your account after completion of payment.
TGG Dollar may be redeemed for certain Products on eShop as may be designated as eligible for redemption by Retailers in their sole discretion. Members may redeem by using a combination of cash and TGG Dollar.
All TGG Dollars required for eShop products redemption must be earned by the same Member under the same TGG account except pursuant to any applicable TGG event rewards. Pooling of Dollars for or by different Members is not allowed.
When a Member places an order by redeeming Dollars, the corresponding number of Dollars will be automatically deducted from the Member’s account at the time when such order is confirmed.
Orders using TGG Dollars products redemption must be placed online on TGG eShop. Members must log into their TGG accounts prior to placing an order that requires the redemption of Dollars.
Orders for TGG Dollars products redemption cannot be made in conjunction with any other offers or promotions unless specifically permitted by these Terms of Service.
Redemption made are non-refundable and non-exchangeable.
The use of TGG Dollars for products redemption shall be final and the utilised Dollars are non-refundable.
Members will only be able to earn Points on the Cash portion of their placed orders that were transacted via a mixture of cash and Dollars.
Without prejudice to the foregoing and for the avoidance of doubt, the TGG programme and the earning and use of Points is further subject to the TGG App general terms and conditions, which can be found here [URL: https://www.tastegourmet.co/zh_HK/terms-and-conditions]. To the extent that the terms set forth in these Terms of Service are inconsistent with the terms of the TGG APP general terms and conditions, the terms set forth in these Terms of Service herein shall apply.

Restricted Products
Some of the Products available for sale on TGG eShop such as alcohol and liquor are age-restricted and you must not purchase those Products if you are below the age of 18.

Information on whether a product is age-restricted and the minimum age requirement is available on the relevant Product page. By placing an order for an age-restricted Product, you confirm that both you and the intended recipient of the Product are of the requisite age (i.e. at least 18 years of age if you are placing an order in Hong Kong). You must ensure that no other person shall use your Account login to purchase age-restricted products and a person aged 18 or above must be present to collect the product, otherwise order shall be withdrawn and attempted at another time to be agreed between you and us. You agree that if any applicable legal requirements for the purchase of a restricted Product is not met, Taste Gourmet Group and the Retailer reserve the right to cancel the relevant portion of your Order. For compliance with applicable law and regulations, Taste Gourmet Group, its service provider(s) and the Retailer may request for proof of identification to verify that you are above 18 years of age. We may cancel your order, refuse collection by you of the restricted Product if you are unable or unwilling to provide proof of identification.

Liability and responsibility for Products

Liability and responsibility for Products provided on or through TGG eShop is limited to damages arising from our gross negligence or wilful misconduct. With respect to Products on TGG eShop for which we are not the actual providers of such Products, we disclaim any and all liability relating to them. Should you have any issues with such Products, we will put you in touch with the Retailer and your sole recourse is with the Retailer who provided such Product and not with us.

Some local laws limit or do not allow the disclaimer of implied or other warranties so the above disclaimer may not apply to you to the extent such local law is applicable to you and these terms.

Intellectual property

All rights, including copyright, know-how, moral rights and other intellectual property rights over all material and content including (but not limited to) text, names, logos, trademarks, service marks, brand names, images, web pages, sound, software, software code, interfaces, website structure and videos, displayed on TGG eShop are the property of the Taste Gourmet Group and where applicable, third parties such as a Retailer or service provider(s) we have engaged.

Your use of TGG eShop and the Services grants no rights to you in relation to our intellectual property rights, our other exclusive rights or those rights of third parties in either TGG eShop or its contents.

By using or accessing the Services you agree to comply with the copyright, trademark, service mark, and all other applicable laws that protect the Services, TGG eShop and its content.

Accuracy of contents

The information provided on TGG eShop is for reference only. All the information and materials contained on TGG eShop are provided “AS IS”. To the extent permitted by applicable law, we disclaim all representations and warranties, express or implied, that content or information displayed on TGG eShop is accurate, complete, up-to-date and/or does not infringe the rights of any third party.

Limitation of liability

Except for death or personal injury caused by our negligence, we accept no liability and shall not be responsible for any indirect, consequential, special, economic or exemplary losses or damages howsoever they may arise, whether foreseeable or otherwise.

Governing law & dispute resolution

These Terms of Service shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law rules.

Unless otherwise required by applicable laws, any dispute, controversy, claim or difference of any kind whatsoever shall arising out of or relating to these Terms of Service against or relating toTGG eShop, any Retailer under these Terms of Service shall be referred to and finally resolved by arbitration in HKSAR in accordance with the Arbitration Rules of the Hong Kong International Arbitration Centre (“HKIAC Rules”) for the time being in force, which rules are deemed to be incorporated by reference in this Section. There will be one (1) arbitrator and the language of the arbitration shall be English. The governing law of this arbitration clause is Hong Kong law.

Territory

The materials on TGG eShop are directed solely at persons accessing TGG eShop from Hong Kong. We make no representation that any product or service referred to on TGG eShop is available, or appropriate for use for any other location.

Variation of / update to Terms of Service

We reserve the right to amend and update these Terms of Service from time to time in our sole discretion. Customers and visitors to TGG eShop are reminded to review the Terms of Service regularly to ensure that they are familiar with the most recent version. By accessing and using TGG eShop, you agree to be bound by the most recent version of the Terms of Service.

Miscellaneous

If any provision of these Terms of Service is found to be invalid or unenforceable by a court of law or arbitral tribunal, such invalidity and unenforceability shall not affect the remainder of the Terms of Service which shall continue in full force and effect.

Nothing in these Terms of Service affects your statutory rights, either as a consumer or otherwise.

In the case of any discrepancy between the English and Chinese language versions of these Terms & Conditions, the English language version shall prevail.
